(North Carolina residents only: see additional term in section 7.9)

1. Acceptance of Terms and Participation: These terms and conditions ("Terms") constitute a legal agreement between You and USAA relating to your participation in either the USAA SafePilot or USAA SafePilot Miles program that you selected. They apply to all of the USAA underwriting companies that provide one of these optional programs to you. “You” or “your” in these Terms means all insured drivers, including minors and any other operators listed on your current auto policy who you may have chosen to enroll. “USAA” or “we” means United Services Automobile Association and its affiliates. These Terms are in addition to and do not replace or modify, any other contract or agreement that applies in connection with any USAA products and/or services.

1.1 Acceptance Through Download and Participation: You are required to accept this agreement if you download and use the USAA DriveSafe™ app. You will receive a link via text to your cell phone number to set up the app. Once you download the app, you must set up multifactor authentication (“MFA”) to use the app. Your participation and continued use of the app is expressly conditioned on your acceptance of all Terms that apply to your selected program. By either downloading and continuing to use the app, or by clicking “next” in the app during set up, you signify to USAA that you understand and agree to the Terms. If you do not agree with any part of these Terms, do not use the app or click “next” during set up. Delete the app and contact USAA to unenroll. By continuing use of the app through the policy term, you and any minors whose participation and use you have authorized, agree to be legally bound by the Terms and agree that data will continue to be collected and used.

1.2 Continued Acceptance and Participation: Continued use and participation of the USAA DriveSafe app through the initial and each renewal term is expressly conditioned on and signifies your continued acceptance of the Terms in place at the time of each renewal. You should continue to review the Terms for any updates either through your app or at https://www.usaa.com/insurance/safedriving/program-terms-and-conditions. If you do not agree with updates to the Terms, take immediate steps to unenroll from the program by calling to make a change to your policy choice. You should also delete the app to avoid any additional data from being collected. If unenrollment is from USAA SafePilot Miles, advise all others in the household to delete the app to stop data collection.

1.3 Age of Majority Acceptance: If you entered into either program as a minor through the acceptance of any agreements and Terms by a parent or guardian who named you on their policy, your parent or guardian originally accepted Terms on your behalf and permitted you to enroll and continue to participate in one of the programs. At age of majority, we will request that you read and accept the Terms on your own if you choose to continue to participate. Through either clicking “next” when you read the Terms or through your continued download and use of the app after reaching age of majority, you signify acceptance. If you do not agree to the Terms, you should not continue to use the app. You should delete the USAA DriveSafe app from your phone and advise us of your unenrollment. If you unenroll from USAA SafePilot, policy rates will be affected, but the remainder of your household may continue in the program. If you are unenrolling from USAA SafePilot Miles, all rated operators in your household will be unenrolled from the program, but we will continue to provide uninterrupted policy coverage to everyone through a traditional auto policy. Policy rates will be affected by any change in programs. We will notify the named insured on the policy of the need to have you review and approve these Terms, or of any changes to the policy caused by your non-acceptance.

1.4 Requirements for Initial and Continued Use: To use or continue to use the app, you must have a compatible phone device with a data plan that permits the running of a version of the USAA DriveSafe app that includes multifactor authentication (“MFA”). You must enroll in MFA to receive access or continued access to the app. This MFA requirement may also require you to update your app. If you do not update to an MFA version of the app, you may no longer be able to access the app. You must be on the most current iOS or Android operating system or one of the prior two versions. If you attempt to use the app on an outdated operating system, the app may not function properly. This means your trips may not be captured, data may not be sent, and you may not receive correct discounts and/or premium applicable to your program. If you are participating in the USAA SafePilot Miles program while using an older operating system than as required, this may result in offline rates being charged if we cannot detect your trips.

If you continue in a program without updating to an MFA version of the app, or you continue to use an older operating system than what we require, we may unenroll you from the program. If you are unenrolled, your policy will remain active, but you will no longer be participating in either safe driving program.

1.5 Program Disclosure: Each program within the USAA DriveSafe mobile application is an optional and limited offering. Availability in your state of any of the programs is dependent on your state’s requirements for each program and the filings in your state being approved. The accuracy and performance on the USAA DriveSafe app is not guaranteed, and specific features may vary by state. Data collection is also dependent on your maintaining a data program and keeping your phone updated with permissions on. Each program is subject to being discontinued or modified at any time.

2. Data Collection; Data Use; Text Messages; Data Storage

2.1 Data Collected: USAA DriveSafe collects personal data about you from your phone as soon as you download the App and begin to use it. Data collected includes contact information and identifiers, date and time, and driving information relating to you and your precise GPS location, trip duration, time of day, phone usage, and phone handling such as being swiped or unlocked, or launching other applications. This data is collected through sensors in your phone such as the barometer, magnetometer, accelerometer, GPS and gyroscope, if available. Much of this data is available to you in the USAA DriveSafe app.

2.2 Use of Data: Data collected through USAA DriveSafe is used to power the safe driving program once you enroll, download the app and begin to use it. Data is used for any business purpose consistent with continuing to offer existing or new programs and to service the programs. Data use includes determining driving scores, appropriate policy pricing, and determining mileage driven. When you participate, you agree and consent to the transmittal, download, retrieval, access, storage, and use of the data by USAA and its third-party service providers which include Cambridge Mobile Telematics (CMT). You also agree that data may be used for any business purposes consistent with the administration of current and future insurance programs and the terms of your auto policy.

Business purposes include:

(Applicable to any policyholders underwritten by USAA Falcon Property and Casualty Insurance Company):

1) the creation of a personalized safe driving adjustment that may result in an increase or decrease to premium at renewal. The data may also be used to determine your future policy premium increases or decreases regardless of enrollment. More information about the personalized safe driving adjustment can be found in the Program Notice that is provided with the policy.

(Applicable to all policyholders underwritten by USAA and its affiliates that includes USAA Falcon Property and Casualty Insurance):

2) understanding your adherence to the Terms; 3) working with third party service providers to assist us with research, testing, development, and analysis so that we may continue to provide new or updated programs and offerings to you; 4) the detection and prevention of fraud; 5) the detection and analysis of losses and collisions; 6) development or implementation of new rating factors and scoring models; 7) determining discounts, surcharges, premiums, rating and underwriting of policies; 8) investigating, adjusting and resolving claims; 9) providing data to third parties as legally required for discovery in lawsuits, claims investigations and when subpoenaed; and 10) for regulatory investigations and inquiries.

2.3 Text Messages: For each enrollee to the safe driving program on the policy to which they are named, USAA or its affiliates, agents, vendors, or service providers (collectively "USAA"), will send text messages ("messages") to the cell phone number provided to USAA through the use of an automated dialing system. BY AGREEING TO THESE TERMS, YOU AGREE THAT USAA MAY SEND TEXT MESSAGES TO THE CELL PHONE NUMBER PROVIDED THROUGH THE USE OF AN AUTOMATED DIALING SYSTEM. Message, data rates and international message charges may apply. Message frequency will vary. Messages may include information about your data no longer being collected, required updates for continued operation of the program, and notifications to anyone reaching age of majority to review and accept Terms for continued participation in one of the programs per Section I of these Terms. You and others no longer wanting to receive texts may opt out by replying Stop or communicating your request to revoke consent to USAA verbally or in writing. If you revoke consent to receive texts, we will communicate through other means that we determine are available to us. All rules of the programs referenced in these Terms and the program notice that include but are not limited to data collection, rating and premium determination, and heartbeat/offline rates in USAA SafePilot Miles will continue to apply.

2.4 Storage of Data: Data that is collected will be securely stored, maintained and retained by USAA and its service providers that include CMT as required by each state’s regulatory bodies and in accordance with all laws, regulations and standards applicable to property and casualty insurance products and lines of business.

3. Enrollment, Eligibility and Device

3.1 Enrollment: To enroll yourself and others in either the USAA SafePilot or USAA SafePilot Miles program and to begin to use the USAA DriveSafe app, you must purchase and be the named insured or spouse listed on a USAA auto policy. You must also have the authority to provide consent for all rated drivers, including minors and operators who you ask us to insure, as well as all vehicles you place on your policy. Your consent also includes your authority to consent to an initial text message being sent to each phone number that you have provided to us. The Terms apply to all insureds on your policy who choose to participate and agree. All minors are subject to the same Terms to which you agree and continue to agree from the time of enrollment. No insured who is listed or added to your policy is ever required to participate. However, participation in USAA SafePilot Miles will require all insureds on your policy to participate, if you choose that program. The programs are voluntary.

3.2 Eligibility: USAA reserves the right to restrict access to or use of its programs as necessary to satisfy legal or regulatory requirements that either presently exist or may exist in the future.

3.3 Device Capabilities and Updates: To participate in either program, you are required to download, install and use the USAA DriveSafe app. The app is available in the Apple App store and Google Play store. All participants, including the minor children you enrolled and authorized to participate, must also download and install the app. You must have a data program. You will be required from time to time to install software updates. Certain features of USAA DriveSafe may require specific hardware elements, such as wireless internet access capability, Bluetooth antenna, or others. You will be prompted at set up to keep certain features of the phone always active. When you do not follow prompts, the app will not operate as designed and determination of your monthly premium may be affected.

4. Termination of Access: USAA may, at any time, suspend your access to USAA DriveSafe app, or any components thereof, at its discretion. You may stop using and uninstall the app at any time. You should uninstall USAA DriveSafe if you transfer your device to someone else. USAA may, without prior notice or liability, discontinue or change any aspect of the programs. This includes restricting or removing access to specific features or data which may previously have been accessible.

5. Information Use and Privacy: Personal information received by USAA will be treated in accordance with the USAA Privacy Promise and Online Practices that can be found at www.usaa.com/privacy. To protect your personal information from unauthorized access and use, we use security measures that comply with applicable state and federal privacy laws. These measures include computer safeguards and physical security at our offices.

- 5.2 Text Messages has been updated.

1. Acceptance of Terms and Participation: These terms and conditions ("Terms") constitute a legal agreement between You and USAA relating to your participation in one of the USAA SafePilot and USAA SafePilot Miles programs. The use of “You” or “your” in these Terms means all insured drivers, including minors and any other operators listed on your current auto policy who you have chosen to enroll in an optional program. “USAA” or “we” means United Services Automobile Association and its affiliates. The Terms apply in addition to, and are not intended to replace, any other contract or agreement that apply in connection with any USAA products and/or services.

1.1 Acceptance Through Download and Participation: You may choose to participate in either a discount program or a usage-based mileage program. Your participation and continued use of the mobile application is expressly conditioned on your acceptance of these Terms that apply to both programs. When you click on the acceptance of the Terms within the USAA DriveSafe™, that click will signify that you have signed and therefore agreed to all of the Terms. If you do not agree with any part of the Terms after your acceptance, you should not continue to participate in the program. If you choose to continue to participate through the policy term, you and any minors whose participation and use you are authorizing, agree to be legally bound by the Terms. Terms may be updated from time to time and will always be available for your review and download. If you do not agree with any updates to the Terms, you should take immediate steps to unenroll from the program by calling or going online to make a change to your policy choice. In conjunction with unenrollment, you and other insureds who have participated in either program should delete the app from your mobile device and discontinue use.

Continued use and participation in either program by you and any end user on your policy serves as confirmation of acceptance of all Terms. If any updates to Terms are not acceptable, you should take immediate steps to unenroll from the program by calling or going online to make a change to your policy choice. In conjunction with unenrollment, you should delete the app from your device and discontinue use.

1.3 Age of Majority Acceptance: If you entered into either program as a minor through the acceptance of any agreements and Terms by a parent or guardian who named you on their policy, your parent or guardian also accepted Terms on your behalf and permitted you to enroll and participate in one of the programs. Once you have reached the age of majority, you are required to read the Terms and determine if you are accepting them and continuing to participate in a program. If you choose to accept them, you may keep using the mobile app, keep it downloaded on your phone, keep all permissions enabled as required for use and continue to send and allow us to use data as specified in these Terms. If you do not agree to any of the Terms, while this will not affect your policy coverage, you may not continue to use the mobile app or participate. You should delete the USAA DriveSafe app from your phone and advise us of your unenrollment. If you unenroll from USAA SafePilot Miles, everyone else named on a policy with you will be required to unenroll from the program, but we will continue to provide uninterrupted coverage to everyone through a traditional auto policy. Policy rates will be affected by any change in programs. We will notify the named insured on the policy of the need to have you review and approve these Terms, or of any changes to the policy caused by your non acceptance.

Your participation and continued use of the mobile application is expressly conditioned on your acceptance of these Terms that apply to both programs. If you do not agree with any part of the Terms, you should not continue to participate in the program. If you choose to continue to participate, you and any minors whose participation and use you are authorizing, agree to be legally bound by the Terms. Your and their continued use of the mobile application throughout the policy term signify your continued agreement with the Terms. Terms may be updated from time to time and will always be available for your review and downloading. If you do not agree with any updates to the Terms, you should take immediate steps to unenroll from the program by calling or going online to make a change to your policy choice. In conjunction with unenrollment, you and other insureds who have participated in one of the programs should delete the app from your mobile device and discontinue use.

1.2 Continued Acceptance and Participation: Continued use and participation through each renewal term is expressly conditioned on your continued acceptance of the Terms in place at that time. You may continue to review the Terms and all updates. All versions of the programs’ Terms are available for your review within your app or at https://www.usaa.com/insurance/safedriving/program-terms-and-conditions.

1.3 Age of Majority Acceptance: If you entered into a program as a minor through the acceptance of any agreements and Terms by a parent or guardian who named you on their policy, your parent or guardian also accepted Terms on your behalf and permitted you to enroll and participate in a SafePilot program. Once you have reached the age of majority, you are required to read the Terms and determine if you are accepting them and continuing to participate in the program. If you choose to accept them, you may keep using the mobile app, keep it downloaded on your phone, keep all permissions enabled as required for use and continue to send and allow us to use data as specified in these Terms. If you do not agree to any of the Terms, while this will not affect your policy coverage, you may not continue to use the mobile app or participate in the program. You should delete the app from your phone and advise us of your unenrollment. If you unenroll from the usage-based mileage program everyone else named on a policy with you will be required to unenroll from the program, but we will continue to provide uninterrupted coverage to everyone through a traditional auto policy. Policy rates will be affected by any change in programs. We will notify the named insured on the policy of the need to have you review and approve these Terms, or of any changes to the policy caused by your non acceptance.

1.4 PROGRAM NOTICE: EACH PROGRAM WITHIN USAA SAFEPILOT IS AN OPTIONAL LIMITED OFFERING. AVAILABILITY IN YOUR STATE OF ANY OF THE PROGRAMS IS DEPENDENT ON YOUR STATE’S REQUIREMENTS FOR EACH PROGRAM AND THE FILINGS IN YOUR STATE. THE ACCURACY AND PERFORMANCE ON THE USAA SAFEPILOT MOBILE APPLICATION IS NOT GUARANTEED AND SPECIFIC FEATURES MAY VARY BY STATE. EACH PROGRAM IS SUBJECT TO BEING DISCONTINUED AT ANY TIME.

2. Enrollment, Eligibility and Device

With your authorization and consent, all minors are subject to the same Terms to which you agree and continue to agree to from the time of enrollment. No insured who is listed or added to your policy is ever required to participate. However, participation in the usage-based insurance program is required of all insureds on your policy, if you choose that program. The programs are voluntary.

2.2 Eligibility: USAA reserves the right to restrict access to or use of its programs as necessary to satisfy legal or regulatory requirements that either presently exist or may exist in the future.

2.3 Device Capabilities and Updates: To participate in either program, you are required to download and install the USAA SafePilot app. The mobile app is available on the Apple App store and Google Play store.  All participants including the minor children you enrolled and authorized to participate must also download and install the app. You will be required from time to time to install software updates. You are able to dispute and adjust the assignment of any trip that you have taken during the most recent 30 days within the app, or through an insurance professional at 800-531-USAA (8722) for any trips beyond 30 days. 5.5 Program Discount

Participation Discount

Upon enrollment, a participation discount will be applied to the auto policy in participating locations. If all drivers in the household do not choose to participate, the participation discount will be reduced and applied based on a proportion of the number of participants. For example, if the maximum available participation discount is 10% and a household of two drivers only elects to have one driver participate, the participation discount will be reduced to 5%.

Earned Driving Discount

Following enrollment, download and use of USAA SafePilot, USAA SafePilot will begin capturing the driving behavior. During the first 14 days, participants will be provided with feedback on their driving behavior. However, the driving behavior of the first 14 days will not be used in the determination of the driving score. After 14 days, the driving behavior will be used in the determination of the driving score. Participants will continue to receive feedback on their driving behavior.

At the end of the participants' initial policy term, the driving score will be converted to an earned driving discount to be applied to the auto policy in participating locations for each participant that has driven at least at minimum 325 miles and 16 hours each term. USAA SafePilot will continue to collect data during the next term for the purpose of scoring the driving behavior to determine if an earned driving discount can be applied for subsequent renewals.

If USAA SafePilot did not receive enough driving behavior information during the policy term, the participation discount will apply while USAA SafePilot collects driving behavior to establish a driving score. The participation discount can be applied up to 365 days if there is not enough data to determine a driving score at each renewal.

5.5 Program Discount

Enrollment & Participation Discount

Upon enrollment, a participation discount will be applied to the auto policy in participating locations. If all drivers in the household do not choose to participate, the participation discount will be reduced and applied based on a proportion of the number of participants. For example, if the maximum available participation discount is 5% and a household of two drivers only elects to have one driver participate, the participation discount will be reduced to 2.5%.

Renewal Discount

Following enrollment, download and use of USAA SafePilot, USAA SafePilot will begin capturing the driving behavior. During the first 14 days, participants will be provided with feedback on their driving behavior. However, the driving behavior of the first 14 days will not be used in the determination of the driving score. After 14 days, the driving behavior will be used in the determination of the driving score. Participants will continue to receive feedback on their driving behavior.

At the end of the participants' initial policy term, the driving score will be converted to a discount to be applied to the auto policy in participating locations. USAA SafePilot will continue to collect data during the next term for the purpose of scoring the driving behavior to determine if a driving discount can be applied for subsequent renewals.

If USAA SafePilot did not receive enough driving behavior information during the policy term, the participation discount will apply while USAA SafePilot collects driving behavior to establish a driving score. The participation discount can be applied up to 365 days if there is not enough data to determine a driving score at each renewal.
