Connected Home Discount Program
This Participation Agreement (“Agreement”) is a legal agreement between you and United Services Automobile Association and its property and casualty insurance affiliates (“USAA”). The Connected Home Discount Program (“Program”) permits USAA homeowner policy (“Policy”) holders who use connected home technology recognized by USAA (“Devices”) to obtain a discount when they share Data (as defined below) from the Devices. The Program is provided in connection with your Policy. Participation in the Program is voluntary and may be terminated at any time. Your use of any Program-related products and/or services not provided by USAA including but not limited to the Devices (“Non-USAA Services”) is at your own expense.
Consent: By participating in the Program you consent to the collection and use of Data terms below
Your Obligations: To obtain the Program discount, you agree to:
- install the required number of eligible devices in the home associated with your Policy
- set up and maintain Non-USAA Services needed to share Data with USAA
You acknowledge that the Program discount may be removed in the event that USAA does not receive Data from the Devices for 60 consecutive days.
Change of Address: Your discount is associated with the location insured by your Policy. A change in address will require that you agree to another participation agreement to receive the Program discount in connection with your Policy.
Collection and Use of Data: As used in this Agreement, “Data” means any and all data and information including any personal information measured, detected, or recorded by the Devices via Non-USAA Services including but not limited to your Wi-Fi network and smartphone, which may be stored or otherwise available on or through a mobile app, cloud platform, application programming interface or website. The Data includes but is not limited to app usage in connection with the Devices, date and/or time of Device activation, Device installation address, assigned Device locations, battery life and Wi-Fi connection status. Data also includes Device readings, smartphone notifications and alerts, responses to alerts (for example: water leaks), and number of alerts shared with others. This excludes any video feeds, still images, or audio from any Devices.
Data captured by the installed Devices will be transmitted and shared with USAA who may process, analyze, and use the Data for purposes of facilitating and evaluating this Program or your use of it (including Device location and addition or deletion of Devices) and for the purposes of research, analysis, and developing and/or improving products and services. Data may be discoverable in a lawsuit or investigation. Participation in the Program may be used to determine the availability of insurance, affect premium, or make renewal decisions about your Policy.
Privacy: PERSONAL INFORMATION THAT USAA OBTAINS IS GOVERNED BY THE USAA PRIVACY PROMISE WHICH CAN BE ACCESSED AT http://www.usaa.com/privacy.
Use in U.S. Only: This Agreement and the Program only apply to Devices used in the United States and excludes Non-USAA Services used outside the United States.
No Representations; No Warranties; Hold Harmless: USAA MAKES NO REPRESENTATIONS NOR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE USE, RELIABILITY, OR COMPATIBILITY OF NONUSAA SERVICES, THE COLLECTION, TRANSMISSION, RECEIPT, USE, OR ANAYSIS OF THE DATA, OR THE PROGRAM. IN NO EVENT SHALL USAA BE LIABLE FOR THE FAILURE OR INCOMPATIBILITY OF NON-USAA SERVICES UTILIZED BY YOU. YOUR USE OF AND RELIANCE ON NON-USAA SERVICES, THE DATA, AND THE PROGRAM IS SOLELY AT YOUR OWN RISK.
YOU HAVE SOLE RESPONSIBILITY FOR THE COLLECTION, TRANSMISSION, AND PROTECTION OF DATA AND/OR NON-USAA SERVICES USED IN CONNECTION WITH THE PROGRAM, AND YOU AGREE TO HOLD USAA HARMLESS FROM, AND YOU COVENANT NOT TO SUE USAA OR ANY OF ITS AFFILIATES FOR, ANY CLAIMS BASED ON YOUR USE OF AND/OR RELIANCE ON NON-USAA SERVICES, THE DATA, OR THE PROGRAM INCLUDING BUT NOT LIMITED TO ANY CLAIMS IN CONNECTION WITH ANY COLLECTION, TRANSMISSION, OR USE OF THE DATA, PROPERTY DAMAGE, UNSAFE CONDITONS, PERSONAL INJURY, DEATH OR OTHER HARMFUL EVENTS. USAA PROVIDES THE PROGRAM “AS-IS” AND “AS-AVAILABLE” AND IS NOT RESPONSIBLE FOR ANY INCOMPLETE OR INACCURATE INFORMATION IN CONNECTION WITH NON-USAA SERVICES, THE DATA, OR THE PROGRAM. USAA HEREBY DISCLAIMS ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
Limitation of Liability: YOU UNDERSTAND AND AGREE THAT USAA AND ITS AFFILIATES HAVE NO LIABILITY FOR DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTIAL, OR SPECIAL DAMAGES RESULTING FROM OR IN CONNECTION WITH NON-USAA SERVICES, THE DATA, OR THE PROGRAM. WITHOUT LIMITATION, USAA AND ITS AFFILIATES HAVE NO LIABILITY FOR DAMAGES OF ANY KIND, INCLUDING BODILY INJURY OR DAMAGE TO ANY PROPERTY CAUSED BY OR IN CONNECTION WITH NON-USAA SERVICES, THE DATA, OR THE PROGRAM.
No Network Security: You are solely responsible for the security to protect your internet connection and use from unauthorized access by third parties. You understand there are risks that a third party could gain access to Non-USAA Services including but not limited to your internet system and/or the Data and you agree to accept those risks. USAA disclaims any and all liability that may arise from or be in connection with the use of Non-USAA Services, the Data, or any unauthorized access to or use of NonUSAA Services or the Data.
No Endorsements: USAA in no way endorses any products or services used in connection with the Program.
Reciprocal Insurance Exchange: You understand that United Services Automobile Association is a reciprocal interinsurance exchange, and as such, you agree that no personal liability shall extend to any officer, director, member, agent or employee of United Services Automobile Association.
Miscellaneous: (a) This Agreement represents the complete agreement between you and USAA concerning the Program, and supersedes all prior or contemporaneous agreements and representation between you and USAA regarding the same subject matter. (b) This Agreement may be amended only by USAA. (c) USAA may modify or terminate this Agreement or the Program or your participation in the Program at any time, for any reason and without prior notification. (d) If any provision of this Agreement is held to be unenforceable for any reason, such provision will be reformed only to the extent necessary to make it enforceable and the remaining provisions of this agreement will not be affected. (e) This Internal Agreement will be governed by the laws of the State of Texas. (f) The United Nations Convention on Contracts for the International Sale of Goods will not apply to this Agreement.
