A will is a document that outlines how a person wants their assets distributed after they die.
If you die without a will, your estate will go through the probate process to distribute your assets.
Yes. A will doesn’t control the distribution of assets that haven’t already gone through probate. It also won’t cover anything that has a beneficiary designation, such as a life insurance policy, or assets you placed in a trust.
A trust is a document that lets you give control of your assets to a trustee. They specify exactly how and when your assets are given to your beneficiaries.
There’s no rule for who does or doesn't need a trust. It just depends on who you want to control what happens to your assets you die.
Probate is a court proceeding. It can validate your loved one’s will and approve or deny the named executor.
It can also help distribute your loved one’s assets.
